The Labor Activity of an Employee in Electronic form

To the attention of the clients of the Morgun and Partners Law Firm with employees, we inform you that on June 10, 2021, the Law of Ukraine signed by the President of Ukraine on March 4, 2021 “On Amendments to Certain Legislative Acts of Ukraine on Recording the Labor Activity of an Employee in Electronic form.”

This Law puts into effect the accounting of the labor activity of employees in electronic form and for employees and employers a transitional period of 5 years (until 06/10/2026) is established for transferring information from paper employment history on the labor activity of employees to the State Register of Compulsory State Social Insurance. During the transition period, you can use both a paper employment history and an electronic form of information about work that is already available or entered.

Information about labor activity is filed by the employee (insured person) and the employer in the form of scanned (digitized) copies of labor, certificates, etc. with the imposition of an electronic digital signature through the web portal of electronic services of the Pension Fund of Ukraine or by contacting the territorial body of the Fund for its intended purpose.

In the future, the employment history will no longer be the main document on labor activity, and after all information about the employee’s work activity is included in the State Register of Compulsory State Social Insurance, the employment history is issued against the signature of the employee and is kept by him. It is important that the owner or the body authorized by him, and in the future, at the request of the employee, is obliged to make entries in the work book about hiring, transfer and dismissal, promotion and rewards for success in work.

What benefits does this law give us?

First of all, it is the transparency of the labor accounting process.
The electronic employment history will allow the authorized bodies to assign pensions and social benefits to citizens automatically. Simplification of the procedure for the employee to collect documents on his labor activity for the purpose of assigning a pension. Open access to information on the acquired insurance experience of employees for the purpose of assigning payments for compulsory state social insurance, primarily in the event of temporary disability. Accounting for data on the education and qualifications of the working population for the formation of the labor market and training (retraining) of specialists in relevant areas. Elimination of bureaucracy and the negative consequences of the loss of a employment history, its physical damage, falsification and the introduction of false information into this document.

What “pitfalls” await us?

The possibility of outside interference in the State Register of Compulsory State Social Insurance through hacker attacks or other unauthorized access to such a register can never be ruled out.
First of all, we recommend that all employers and employees carefully check work books for compliance with regulatory and legislative documents regulating the maintenance of work books and accounting of labor activity in electronic form and enter information into the State Register of Compulsory State Social Insurance on the labor activity of those employees who in the near future reach retirement age and be eligible for a pension.
