How to properly transfer a vehicle for the needs of volunteers

Today, a vehicle is one of the most important gifts for volunteering. Since the beginning of the full-scale invasion, thanks to domestic businesses, foreign sponsors and ordinary citizens of Ukraine, volunteers have received more than 2 thousand vehicles, but in many cases questions have repeatedly arisen when giving this type of gift. In this article, we will consider several stages of the transfer of a vehicle for the needs of volunteers.
Stage 1. If the vehicle is donated by a person who is officially married, you should pay attention to exactly when the vehicle was purchased, because if the vehicle was purchased for the joint funds of the spouses, the voluntary written consent of the second spouse is required. If a legal entity has expressed a desire to donate the vehicle, in this case the head must issue an order “On the provision of charitable assistance to volunteer activities” or convene a general meeting and draw up everything in the minutes of the general meeting (decision of the founder).
2nd stage. Giving a gift of this kind must be formalized through a donation contract. In accordance with the current legislation of Ukraine, a donation is considered a targeted donation of a thing to achieve a specific agreed goal. The donation contract must be concluded in writing, and at the request of the parties it can be notarized. To the donation agreement, it is also necessary to draw up an act of acceptance and transfer of the vehicle.
3rd stage. Prior to the introduction of martial law in Ukraine, the new owner of the vehicle was obliged, within 10 days after the conclusion of the contract, to re-register the ownership of the vehicle at the service center of the Ministry of Internal Affairs, due to the introduction of martial law, this period was extended to 90 days, however, at the time of martial law, the standard the requirements of the Ministry of Internal Affairs for the conclusion of the contract remained unchanged. A used car donation agreement can be signed at a service center of the Ministry of Internal Affairs or TsNAP in the presence of the parties to the agreement (an exception is a notarized agreement).
4-stage. After registration of ownership of the vehicle, volunteers can safely use this gift. At the same time, it is necessary to pay attention to the fact that non-profit organizations must use the vehicle exclusively for their activities (this is noted by the legislator in Article 133.4.2. of the Tax Code of Ukraine). If the vehicle will be used for personal purposes, that is, not for its intended purpose, the donor has the right to demand termination of the donation agreement in accordance with the norms of the Civil Code of Ukraine.
From the first days of a full-scale invasion, thanks to donated vehicles, volunteers daily perform a number of important tasks: evacuate civilians from areas where active hostilities are underway; rescue and deliver to medical facilities the wounded and sick people affected by Russian aggression; carry out the transportation of various kinds of humanitarian aid to different regions of the country and to the most inaccessible places.
